Terms and Conditions of Sale

1. Company Identity and Scope

These General Terms and Conditions of Sale and Use (GTC/GTU) govern all relations between the Seller and any person accessing the site or making a purchase (hereinafter "the Customer"). Any order implies full and unreserved acceptance of these conditions.

2. Site Access and Age Restrictions

The site is accessible to any adult with legal capacity.

Certain products are subject to legal restrictions, including:

• Tobacco products and vape accessories
• Adult items
• Sensitive products

Age Verification — In accordance with Swiss law (LPTab): Sales are strictly prohibited to persons under 18 years of age. By placing an order, the Customer certifies that they are of legal age. The Seller reserves the right to request official identification before any shipment. In the absence of proof or in case of refusal, the order will be canceled without compensation.

3. Products and Availability

Products are described with the greatest possible accuracy. However, visuals are non-contractual, and slight variations in color or rendering may exist depending on the screen. Stocks are limited, and the Seller reserves the right to withdraw or modify a product at any time without prior notice.

4. Order and Contract Formation

The ordering process includes the following steps:

1. Product selection
2. Cart validation
3. Payment
4. Email confirmation

The sales contract is deemed formed only after receipt of the order confirmation by email. The Seller reserves the right to refuse any suspicious order or to cancel an order in case of proven fraud, ongoing dispute, or obvious pricing error.

5. Price, VAT, and Fees

Prices are displayed in Swiss Francs (CHF) or Euros (EUR), all taxes included, depending on the Customer's browsing preference.

Orders to the European Union: Orders destined for the EU are mostly shipped from our warehouse in France. In approximately 95% of cases, no customs fees or additional taxes apply. In exceptional cases where the shipment is made from Switzerland, any customs duties and import taxes remain the sole responsibility of the recipient Customer.

Applicable delivery costs are clearly indicated before payment validation.

6. Payment

Payments are secured via Shopify and its certified payment partners. Accepted payment methods are credit card and digital payments, subject to availability. The Seller does not store any complete banking data — this information is processed exclusively by our certified providers.

7. Delivery

Orders are shipped from our warehouse in France or from our headquarters in Switzerland, depending on stock availability and the delivery address. Indicated delivery times are given as an estimate and do not constitute a contractual guarantee.

Transfer of risks:

• Switzerland: in accordance with Article 185 of the Code of Obligations (CO), risks are transferred to the Customer upon conclusion of the contract.
• European Union: risks are transferred to the Customer upon effective receipt of the package.

In case of an unclaimed package returned to the Seller, re-shipping or return costs will be deducted from any refund.

8. Right of Withdrawal and Returns

The Customer has a period of 30 days from the receipt of the package to exercise their right of withdrawal, provided that the product is returned in its original, unused condition, with its intact packaging.

Strict exceptions for hygiene and safety reasons — no returns possible if the packaging has been opened for:

• Underwear and lingerie items
• Sex toys and intimate accessories
• Cosmetic products
• Consumable products
• Opened Blind Boxes (the principle of surprise being constitutive of the product)

9. Warranty and Defects

The Seller applies the legal warranty of 2 years in accordance with applicable legislation. Any manufacturing defect must be reported in writing, with a supporting photo, within 7 days following receipt of the package.

Not covered by the warranty: normal wear and tear, improper use of the product, damage caused intentionally or resulting from inadequate maintenance.

Depending on the case, the Seller may offer a repair, replacement, or refund.

10. Liability

The Seller cannot be held liable for misuse of the product by the Customer, indirect or immaterial damages, or a delivery delay beyond its control. The Customer is solely responsible for the use they make of the products purchased on the site.

11. Personal Data

Personal data collected during the order are processed in accordance with the Federal Act on Data Protection (nFADP) for Swiss customers, and the General Data Protection Regulation (GDPR) for European customers. Certain data may be transmitted to third parties strictly for delivery, payment processing, or age verification purposes. 12. Intellectual Property

All elements of the lsdlboutique.ch site — texts, images, logos, graphics, structure — are protected by intellectual property law. Any reproduction, representation, or use, even partial, is strictly prohibited without prior written authorization from the Seller.

13. Force Majeure

The Seller cannot be held responsible for the total or partial non-performance of its obligations in the event of a force majeure event, including natural disaster, fire, strike, pandemic, carrier failure, or any other major logistical event beyond its control.

14. Applicable Law and Jurisdiction

These GTC/GTU are subject to Swiss law. In case of dispute, the exclusive place of jurisdiction is Sion (Valais), Switzerland, subject to the mandatory rights enjoyed by European consumers under the legislation of their country of residence.

15. Loyalty Program and Promotional Games

15.1 A free loyalty program, with no purchase obligation, is offered to Customers, in the form of points called "stars," associated with the Customer's email address.

15.2 Earning stars: 1 CHF/EUR spent = 1 star, multiplied according to the loyalty tier reached (Bronze x1, Silver x1.25, Gold x1.5, Diamond x2); birthday bonus (100 stars/year); referral (100 stars for the referrer, 50 for the referred friend on their first order); product review (25 stars); participation in the Quiz "Which LSDL universe are you?" (20 fixed stars, no drawing).

15.3 Value and exchange: stars can be exchanged for free delivery (50 stars), 5 CHF/EUR discount (100 stars), 10 CHF/EUR discount (200 stars), or 25 CHF/EUR discount (500 stars). Discount codes resulting from an exchange are valid for 90 days. The star balance is reset to zero after 12 months of account inactivity.

15.4 Free games (Wheel of Fortune, Quiz): access is free, with no purchase obligation, limited to one participation per person (identified by their email address) and per game. The Seller reserves the right to invalidate any fraudulent or duplicate participation (multiple accounts, use of bots). The Wheel of Fortune awards a single-use discount code, valid for 14 days, applicable to the entire cart except for already discounted items. Benefits from the loyalty program and games cannot be combined with each other or with another promotional code on the same order.

15.5 The Seller reserves the right to modify, suspend, or terminate, at any time and without prior notice, the loyalty program and the games offered, without this giving rise to compensation, subject to the preservation of rights already acquired at the time of modification.
